In an interview with the High Council for Human Rights, Seyyed Hossein Mousavifar, the Director of the International Law and Human Rights Deputy of the Judiciary Research Institute discussed the legal and judicial measures adopted with respect to the case of Soleimani's assassination and said: “the main measures taken by the judiciary and especially by the HCHR from the beginning of this unfortunate and terrorist incident include investigation into the crime, conducting and holding numerous meetings with academics and officials inside and outside the judiciary in order to use their detailed opinions and resolve this case legally.
Mousavidar stated that a petition was prepared in order for the legal process to move through its process, adding that in addition to the perpetrators of this crime, the US President and those in the United States who have claimed responsibility for this terrorist act , there are other perpetrators whose charges are mainly in accordance with the domestic laws of our country and the general international law on terrorism and deprivation of the right to life, which are counted and summarized in due time so that terrorists are brought to justice.
Noting that the number of defendants has risen to 48 as a result of the investigation, he said that a very important issue in the international arena is using the capacity of the 1973 Convention. The Deputy of International Affairs to the Judiciary has taken extensive steps, both theoretically and administratively to resolve disputes over this mechanism.
Mousavidfar further referred to the issue of trial or extradition of the mentioned criminals and added: "according to the convention, this issue should also be activated and reach a conclusion."
Regarding the responsibility of the Iraqi government for this assassination, he said: "Iraq is the official hosting country and in the first place, the sovereignty of Iraq has been violated and this criminal act against the official of the Islamic Republic of Iran has placed a heavy responsibility on the Iraqi government; therefore, cooperation in the fight against terrorism and the promotion of cooperation in the international arena and a more active role in this field, while supporting and defending its sovereignty, can prove Iraq’s commitment to the security of the officials of the Islamic Republic of Iran.
On the Islamic Republic's revenge against the perpetrators of the assassination of Martyr Soleimani, Mousavifar acknowledged that legitimate defense has begun in the military, political and legal fields. But in the legal field, our best revenge is to defend the trampled blood of General Soleimani in various international arenas, including the United Nations, the Human Rights Council, and to use the capacities contained in international documents. We must defend the blood of the martyrs of the resistance in the best possible way and create lasting legal deterrence, he added.
